Speck Gear Terms and Conditions

These General Terms and Conditions of SPECK GEAR as the seller and you as the customer apply to all orders placed in the SPECK GEAR online shop (www.speckgear.com) as well as to those purchases for which SPECK GEAR declares these Terms and Conditions to be applicable.

1.  Scope

The Terms and Conditions apply to all services provided by SPECK GEAR in the online shop (www.speckgear.com) and become valid upon conclusion of a contract. Deliveries, services, and offers from SPECK GEAR are made exclusively on the basis of these Terms and Conditions, even if they are not expressly agreed upon again. By submitting an order to SPECK GEAR, you confirm that you have read these Terms and Conditions and expressly agree to them.

 

2.  Conclusion of a contract

All information about goods and prices within the ordering process is subject to change and non-binding. Orders are binding for customers. Accordingly, orders cannot be changed or canceled. Customers receive a non-binding confirmation of the order from the seller. SPECK GEAR may revoke its offer without further notice prior to notification of shipment, which constitutes the conclusion of the contract with the seller. By placing your order, you confirm that you are aware of the scope and content of your order. Any questions in this regard can therefore be clarified with us in advance.

 

3.  Delivery

Goods are generally delivered by post or courier. The delivery time in Switzerland is usually 3 to 5 working days, unless otherwise stated for the respective product. This information is provided without guarantee.

If the sender provides an incorrect address or an address where the postal service cannot locate the person, the return costs charged by the postal service must be borne by the customer. Once the goods have been handed over to the postal service, SPECK GEAR is no longer liable. SPECK GEAR therefore does not bear the transport risk.

If, in exceptional cases, an item from the range is not available, we will inform you as soon as possible by email. SPECK GEAR reserves the right to make partial deliveries if this appears to be in the interests of efficient processing of the overall delivery. In such cases, no further shipping costs will be charged for the subsequent delivery. SPECK GEAR also reserves the right to request 100% prepayment for international deliveries.

 

4.  Prices

All prices on www.speckgear.com include Swiss VAT and exclude shipping costs. The actual shipping costs are displayed in the shopping cart before the order is completed. SPECK GEAR expressly reserves the right to adjust the prices quoted online at any time without prior notice and without further explanation. Prices are calculated based on the time of order on the website.

 

5.  Shipping costs

Shipping costs are calculated based on the current prices of SwissPost and any additional costs incurred for packaging.

 

6.  Payment terms

The invoice recipient is the company FORMZONE CHRISTIAN SPECK (VAT number: CHE-110.571.724), which is registered in the commercial register and operates SPECK GEAR. The following payment options are available to you:
At present, we only offer direct purchase by credit card (via Shopify Payments). We also reserve the right to offer PayPal and prepayment by bank transfer.
For prepayment by bank transfer, the payment period is usually 7 days. If payment is not received within this period, SPECK GEAR reserves the right to cancel the order and release the goods for sale again. Any transfer fees are to be borne by you.

Upon conclusion of the purchase contract, Shopify Payments takes over the invoice claim and handles the corresponding payment modalities. When making a purchase, you accept the terms and conditions of Shopify Payments in addition to our terms and conditions.

 

7.  Retention of title; offsetting; right of retention

(1) In the case of consumers, we retain title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising a commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security interests are transferable to third parties.
(2) You are only entitled to offset if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.
(3) If the customer is in default of any payment obligations to us, all existing claims shall become due immediately.

 

8.  Warranty and guarantee

The warranty for goods complies with generally accepted standards and is valid for 24 months, unless a longer or shorter warranty period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or after the damage has occurred, otherwise the warranty claim will be void. The warranty claim is valid from the date of delivery. It expires in the event of improper use or natural wear and tear. SPECK GEAR reserves the right to decide on a case-by-case basis in the event of a warranty claim.

 

9.  Return guarantee

Every buyer has the right to return items received (except vouchers) to SPECK GEAR within 10 days. Items must be returned in perfect condition, otherwise the right to return them will be forfeited. For returns, the buyer will be charged the shipping costs incurred by SPECK GEAR or these will be deducted from the refund amount. The buyer must bear the return shipping costs. By accepting the terms and conditions, you also automatically accept our return policy.

 

10.  Minor model deviations

The design of individual items may change slightly. SPECK GEAR cannot accept any liability for such modifications.

 

11.  Care/handling

SPECK GEAR accepts no liability for the customer's misuse in the care and/or handling of the delivered items.

 

12.  Data protection

SPECK GEAR undertakes to process your customer data carefully and to comply with the provisions of the relevant data protection legislation. In particular, no data will be passed on to third parties. However, no liability can be accepted for the security of data transmitted via the Internet.

 

13.  Marketing

SPECK GEAR reserves the right to reuse the email address and telephone number provided when placing an order for its own marketing purposes (newsletter & other). You can opt out of this by sending a personal email to shop(at)speckgear.com.

 

14.  Product reviews

After purchase, SPECK GEAR sends automated emails asking customers to review the products they have purchased. SPECK GEAR reserves the right to use these and all other reviews (without email requests) for marketing purposes.

 

15.  Vouchers

The voucher is valid for a period of 5 years from the date of issue.

• Vouchers can only be redeemed in the online shop at www.speckgear.com and do not apply to any shipping costs.
• A voucher can only be redeemed once for a single order. It is not possible to split the voucher value across multiple orders.
• Cash payment of the voucher or any remaining balance is excluded, provided this is legally permissible. If a service is no longer available, we reserve the right to refund the voucher value in cash.
• Vouchers that have been personalized or already redeemed are excluded from the right of withdrawal.
• SPECK GEAR accepts no liability for lost vouchers, unless the loss was caused by us.
• Vouchers may not be reproduced or resold without our consent. In the event of misuse, we reserve the right to block the voucher.
• No interest is paid on the credit balance on the voucher.
• Personal vouchers that have been created for a specific person or group may not be passed on and may only be redeemed by persons authorized by SPECK GEAR. SPECK GEAR reserves the right to cancel all unauthorized orders without comment.
• Only one discount code may be used per order.

 

16.  General liability

It is hereby expressly stated that no liability claims for direct and indirect, immediate and consequential damages, including consequential damages, can be asserted against SPECK GEAR by the customer, unless there is intent or gross negligence on the part of SPECK GEAR for the damages incurred. For example, damage resulting from accidents, falls, etc. that occur while using SPECK GEAR products is your own responsibility.

 

17.  Changes to the Terms and Conditions

SPECK GEAR expressly reserves the right to unilaterally change these Terms and Conditions at any time without prior notice..

 

18.  Applicable law/place of jurisdiction

In any case, the relationship between you and SPECK GEAR is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (CO) and the Swiss Civil Code (CC). The place of jurisdiction is Switzerland. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence (principle of favorability).
The right to bring an action before a court in another legal jurisdiction remains unaffected by this.
The application of the provisions of the Vienna Sales Convention (“United Nations Convention on Contracts for the International Sale of Goods”) is expressly excluded.

 

19.  Severability clause

Should individual provisions of this contract prove to be invalid, this shall not affect the remaining provisions of this agreement. In this case, the invalid provision shall be replaced by a new provision that corresponds to the intended purpose or, if this is not possible, comes as close as possible to it.
